The Changing Business of Courts: Modernization of Our Civil Legal System

Over the past decade, fewer and fewer businesses and individuals have used their state or local court to resolve civil disputes. Court leaders and court users alike have expressed concern that court processes are too lengthy, too costly, and too unpredictable. Nearly everyone involved with the civil legal system—judges, attorneys, and litigants—agrees it must be made more fair and efficient. As the public and private sector recover from the pandemic, how can we modernize the legal system?

In our session, we will describe the changing landscape of the civil legal system, including the concentration of civil cases into fewer and fewer actors handling fewer types of disputes. We will then examine reform efforts aimed at making the courts more transparent and more user friendly. Our discussion will highlight the Regulatory Sandbox in Utah which is a policy tool through which new models or services can be offered and tested to assess marketability and impact and inform future policy-making.
